Class Action Lawsuit FIled Against LG For G2x Troubles

It isn’t an everyday thing that we write about a class action lawsuit because they are often common and sometimes ridiculously trivial. This time a class action lawsuit has begun against LG claiming that the company has failed to remedy various problems and defects in an appropriate time frame. Terry Horvath seeks to represent a class of T-Mobile G2x owners who are suffering from the same problems, defects and difficulties and believe that LG has failed to deliver on its promises to fix the problems in a timely fashion.

While I don’t know if a class action lawsuit has any merit a best case result might see LG spring to action and fix the situation like yesterday. The thing is, these users are completely right and LG and T-Mobile have failed G2x owners at almost every turn since this device was first reported to suffer various troubles. In fact the last we heard from LG was on June 23rd when they promised to release more information in a “few days” and today is July 19th and so we think a “few days” is long over.

Now I know that earlier this week some T-Mobile employees received a test build of Gingerbread to demo so we can only hope that means a software update is close to release. Of course we’ve heard something is “close” to release so many times when it comes to the G2x that anything LG or T-Mobile says right now is almost taken without merit.

T-Mobile and LG have to answer to their customers regarding this device and if they won’t then a class action lawsuit is a next step. An extreme step for certain but one that might actually be necessary to get them to respond once again to all the complaints surfacing.

    Awesome it’s about time that these phone manufactures take responsibility for their actions maybe if they weren’t so obsessed in releasing a phone every 2 weeks and focus more on releasing a decent phone every year maybe this wouldnt have happened.Honestly because of the g2x issues I had to sell my phone it could have been great if only LG actually supported it.

        Yea I too heard all the advice to never go with LG cause they had a reputation but I thought hey Maybe this phone will be really great and it was if only they fixed the issues……

          Wow all the hate, i love my g2x and have no issues that I havnt with my previous androids at some point including the HTC incredible, and G1. It is the best android phone out in my opinion, but than again mine is rooted with a custom kernel and CM7 nightly. Battery life averages around 18 hours, quadrant scores of > 4000, tegra games (sorry sensation), IPS screen (lcd density dropped to look HD res). My wife has the sensation and i can promise you it gets more hot (really hot) and does not run tegra2 games like my g2x. Not to mention more sleek and lighter. Everyone needs to go on XDA forums and read a little and there is a fix for almost every problem. Custom roms and root are definitely the way to go, that is the basis of AOSP (android OS).

        Couldn’t agree more re: LG. My fam had the ‘touch’ models with Verizon. Those buggers made us go thru 3 failed handsets before they would switch our phones – then they offered us the Samsung Reality. And they’re wondering why I’m moving 6 lines of service. I just need a stable phone and a hot (and stable) pipe. @#$%!

        I actually sold mine on craigslist for 280$ I didn’t really care about the money I just wanted to get some cash so I could buy myself a decent phone! I mean it was really unacceptable my phone had screen Bleed issues,wifi,gps,signal,and all tmobile ever told me was there was nothing they could do at this time!

    Not a big fan of class action suits, but from everything I’ve heard this one is needed. I did my homework and bought the Sensation after seeing the significant pains suffered by G2X owners.

Hmm, I wonder what LG and T-Mobile are going to do when this magical update doesn’t do the trick and new problems develop. So lame T-Mobile, LOL! T-Mobile USA has once again pioneered a new first in the wireless carrier industry, HOW TO IRK YOUR CUSTOMERS BEYOND REDEMPTION! New iPhone 5 on Verizon (not AT&T-Mobile) here we come! T-Mobile, err, I mean AT&T, you (now) suck so bad! Selling us out then sticking it to us with this problematic G2X!

      All you dim wads should just be quiet. To everyone thinking that T-Mobile should just give you a different device should hang yourself for two reasons: 1. T-Mobile does not make the phone. Once you have that concept grasped, then your anger will subside. It’s not truly T-Mobile’s issue or responsibility to fix a phone. It’s LG’S. 2. Just bc there is an issue with the phone doesn’t mean a different one. How many brand new cars and trucks have recalls? (all of them) how many car makers say hey, come get a DIFFERENT make and model car? None of them. So stop your whining. That’s why the lawsuit names Lg….

        Wrong on every level….for one simple reason. The phone IS NOT LG G2x, it is labeled and sold as TMobile G2x. Once TMobile slapped their name on it it became their problem and responsibility to take care of this matter.

        Same goes for when you buy a Dell PC. Do you go after the motherboard manufacture or do you hold Dell liable for a bad motherboard? ?

          Wrong Dell purchases the components from companies and puts the parts together and slaps their label on it. Just like TMobile did with the G2x. Example, Dell inkjet aio printers are Lexmark aio with a Dell label & firmware, at what point did Dell manufacturer that printer?? They paid Lexmark to do the work for them, just like T-mobile did with LG.

          Sadly your logic is the one that’s flawed.

          While TMo made the choice to sell it, LG should have never allowed the phone to reach that point until the issues were relatively fixed.

        wow lol so according to u or unless u misspoke – every car company has every car and truck recalled at some point or another – lol Not only do i agree with RobertP but u also cant compare a CAR to a Cell phone – bc i Tmobile f ur car is messed up in a way that stops it from working properly then um theres a big safety issue here and Lives could be at stake – u ever heard of a cell phone killing someone lol well—maybe the G2x might be the first lol while ur driving and trying to reboot ur phone u lose control of your car lol aaaahhhhahaha but still advertises this phone – backs this phone – tells u how great this phone is and holds u into their contract when u get this phone – and imagine paying all that money per month for a service u cant take advantage of bc ur on phone #5 and the last 4 prevented u from using ur service 

        LG doesnt hold u to contract and since we r one the subject of electronics – have u ever worked retail at say best buy – i have – i also used to work for T mo – this is only MY OPINION – but from what ive seen – no other electronic device gets returned or warrentied out more then smart phones  – Go ask any random person who has a smart  phone how many phones they had through a warranty exchange – most commonly its 2-3 – And working at Tmobile I can ALMOST say every customer i encountered was on a 2nd or 3rd exchange of their phone – Now Go back to electronic retail – ok now ask me if i ever saw a line of customers standing at returns and they each had lg sony or samsung 32 inch lcd tv to bring back bc it didn’t work – lol never – im not saying they don’t get returned or break but u didn’t see customers bring back or exchange 30 tvs of the same model in a week or 40 of the same computer bc it just didn’t work right! IMO both companies should be held accountable – hey if we hold up our end of paying every month and forking over hundreds or thousands of dollars – why cant they ensure us that we get good devices that work 

        – After all —– its not our job to make sure phones work right – is it

        Although they might not have a legal obligation T-Moble has a business obligation and a moral obligation to fix this issue with it’s customers. I am a T-Mobile customer, and as such, my agreement and relationship is with T-Moble, not LG. If a suit is filed against T-Moble, then T-Mobile can and should go after LG for any damages it suffers as a result of the suit. I have been a T-Mobile customer for more than 7 years. I purchased the G2x in April after the sales people told me it was the best phone on the market. Not only has it been the worst phone I’ve EVER used (battery life ~4 hrs, random reboots, terrible reception, shut downs, etc), T-Mobile, who I always lauded as having the best customer service, has completely failed in supporting me and many many other loyal customers. I expect this type of treatment from a company like AT&T, but not T-Mobile. If Gingerbread doesn’t fix this issues and/or T-Mobile doesn’t offer a replacement exchange, I will gladly pay my $200 to go to another carrier and leave T-Mobile forever. I’m guessing I’m not alone. T-Mobile should look at the cost of acquisition of a new customer and see if it’s worth replacing a customer like me who has spent tens of thousands of dollars with them and would continue to do so if they took care of me.

      how is t-mobile failing to support it? Why replace a device when it is going to have the same issue?? Come on, LG controls the software and it is them who is not supporting it. Rooting is an option but noteveryone wants to do that.

      I don’t think Gingerbread is the solution. I rooted and installed CM7.1 RC1 (android 2.3.4) on my G2X. My phone still randomly reboots and has network connectivity issues. I am on my 3rd phone now and TMobile says that they are no longer doing exchanges until LG releases the update.

    I can’t say I’m surprised. Why release a product with froyo and promise gingerbread in a “few weeks” as they put it. Of course they’ve lost the trust of those who bought the G2x with the hope of an upgrade coming right around the corner.

    I think most people were waiting hoping the promise upgrade to gingerbread would fix the bugs but that never came. And come to think about it, T-mobile, LG and the so called LG Girl were all selling this thing as a pure google experience; that was to translate into fewer bugs and faster updates. That sure happened. 

    I don’t know if this lawsuit will survive but they deserve to be sued. One thing I hate about these class action lawsuit is that only the lawyers cash out. The defendants get what, 20 bucks each?

    this is a classic example of behavior that irreparably tarnishes company brands…yes, you T-Mobile USA and LG Mobile.   if this is the behavior we can expect from T-Mobile, I will not be sad switching to Sprint when AT&T takes over.

    There is only one way for TMobile and LG to redeem themselves. Pay the lawyers who are suing you rightfully and recall this piece of crap they call g2x. Nothing less than replacing this phone with some other equivalent or better phone is acceptable. I got my phone replaced  under warranty because it was freezing and guess what? In winter it could have served some purpose. If someone knows then please post how I can join the class action lawsuit. iPhone would have been recalled long time ago if it had this many problems. I suppose this shows how immature Android vendors are. I will stick to Apple next time. I can walk to apple store and dump the device for replacement with no hassle. That’s called customer service.     There is only one way for TMobile and LG to redeem themselves. Pay the lawyers who are suing you rightfully and recall this piece of crap they call g2x.     Um, so is anyone else happy that they got the Sensation instead of the G2X? I know I sure am. I really liked the G2X when it first came out but then decided to wait and see, and I’m glad I did. There’s a reason many of us are loyal to HTC. Build quality is usually top notch.

    LG has certainly deserved this lawsuit. i will join it if i can. Tmobile has also handled this situation very poorly.  Due to this and other customer service blunders i have closed my account with tmobile.  i will not be trapped into the new b.s. that they have started. Its so bad that the rep didnt even offer me some sort of deal to stay with them.  Im free now and can buy any phone i want without being locked into a contract and my phone bill is much cheaper now…$3 a month for unlimited minutes on my G2X/Tablet.  Good Bye T-molose

  • Thank god. I’m about to chuck this G2x out the window. This thing is Horrible’ (w/ nasty french e accent at the end). Battery life, random reboots, freezing & my thing is rooted, but no I didn’t put any custom rom’s, I just did a simple root because all I wanted to primarily fix is the underwhelming battery life. I mean I’m mad because I spent money to get this, & I wanted to keep this phone for a year, & here I am about to shop around for another one.

    • as far as battery life goes. use setcpu to underclock when your screen is off. my phone lasts two days with light use between charges, and if i use it to play music at work it lasts a whole shift (10 hrs.) and then some.

      • Did that already, lol. That’s one reason why I rooted it to be able to do that. What did you set yours to while your screen is off? I’m checking to see if I have the same settings.

    the only problems i have seen is that the light on the top of the phone bleeds through and i have been having couple of random restarts which is weird. but other than that the phone works good. i hope tmobile fixes it or offers us to exchange for another smartphone maybe like the sensation or something

    I’m on my 2nd G2x… but still have the same issues on the 2nd one as the first one.  The random reboots have become even more frequent as of late- as much as 3 times a day.  I’m all for this lawsuit if only to light a fire under LG/TMo to get an update out.

    I went through 4 G2x and then tmobile customer service told me that i had to trouble shoot the phone. I told then so I pay u guys for service and pay for this stupid phone plus I have to fix this crappy phone.       y were u so worried about 3g bands. the deal is prob a year away, prob another 6 months for transition and then maybe 18+ more months until atnt actually turns off most of T-mobile’s HSPA network to refarm. By this time you probably wouldve upgraded anyway

    Even with the occasional unexpected re-boot.  The phone is fantastic and a powerful piece of equipment.  I don’t like the re-boots but it so much more tolerable than the last phone that I had.  I had an operating system that took nearly all of the RAM to run.  I won’t say what that OS was but it rhymes with mindows.  I like the G2X and only hope that Gingerbread comes out soon so that G2X owners don’t get dusted by the next quarterly release of superphones.

  • The first thing T-Mo needs to do is look at its own quality controls.  They went through this with several devices already….Two of which I own (the vibrant and G2x)…..T-Mo should rigorously test new devices so they at least give the consumer an acceptable experience (you only get one time to make a 1st impression)….T-Mo (and all  other service providers) should also restructure contracts with device makers(which has specific clauses)  in regards to quality of hardware and software.  I understand that no device is perfect. But its not fair that I should spend my hard earned dollar and get a bad product.  LG needs to step its game up in regards to software because it essential to the end user experience.  If it wasn’t for CM7 I would have returned the G2x….Samsung saw the #neveragain campaign and stepped its game up.  Now Its your turn LG…I’m rooting for Android all day every day but device makers need to take notes from Steve’s forbidden fruit and focus on the end user experience.

    My sister’s G2x heated up while charging at night. And as usual she wakes up to her phone, and when she grabbed it she said it was incredibly hot and she dropped her phone and noticed her phone was shutting off due to overheating.

      I’ve only seen the overheating issues with certain apps going crazy.  This started happening on my wife’s G2x, but that was because she tried to add a new email account unsuccessfully, but it kept trying to connect (that’s what we determined).  Her phone would get hotter than hell.  The second she deleted that corrupt email account, phone went back to normal.

    And to add about the + of custom roms is most of  if not all of the phones problems are software related and NOT hardware, so in terms of LG not producing a quality phone- is not true. The hardware is top notch with the exception of slight LCD bleeding (which is a trade-off of IPS displays). Distinguishing what phones have normal bleeding and what phones have a defective bleeding are up to the end users knowledge or lack there of which I am sure Tmobile do not have and have gladly exchanged for replacement phones. If LG are guilty of anything, is releasing this phone pre-maturely; not thoroughly testing the software with the phone. They should of waited and released the phone to public with Gingerbread…

    • Not entirely true, i rooted and added a custom rom to mine and it still had the random shut down issues. it may be software related, but if it is, then the issue was transfered to the rom i loaded.

      I’ve had CM7’s nightly, Team Whiskey’s rom, and the official CM7 with faux’s kernel on my g2x, and I continue to have the same problems (random reboots, failure to charge, device overheating, audio issues).  So believe me, custom roms do not fix everything.

  • As much as I want an update, I haven’t encountered that many problems with my. I have two g2x’s at home (wife) and we don’t see that many random reboots, battery pulls , etc etc. I do love this phone but if they do offer replacement for something newer, I wouldn’t mind trading.

      hi i am another person that has been slamed in to this phone they  know it had problems because you always get the very rehursed answer we are working to fix it but for now lets look at then the reboot it and turn off bluetooth,wifi dim the screen ,lower the ring volume in other words anything they can do to make it use less battery in my oppion we as customers that bought that phone in good faith i personaly feel we should be rembursed for all the time we have had the phone since it only works when it wants to so why pay for what we cant use and also we should be rembursed for what we paid for the phone and also if we want out of our contract we should have that option also i personaly dont like being lied to thanks for your time sincerly brian

    I bought a Sensation and I “Sense” (heh… pun) I’m heading down the same road.  We’re only at firmware 1.29 while the rest of the world has gotten 2, even 3 FOTAs since.  I barely have any custom apps installed and it gets unstable every few hours at times.  The touch screen goes wonky.  Youtube is choppy and slow.

    I fear we just have to accept that T-Mobile has given up on daily operations while they wait to be absorbed by the gelatinous blob we better know as AT&T.

    Some of you may be asking why wasn’t T-Mobile sued.  Most likely it’s the U.S. Supreme Court case AT&T Mobility v. Concepcion, a case that ended all consumer class action litigation.

    What LG will do is invoke the carrier’s arbitration clause on the class action, saying that since there’s an arbitration clause between the Plaintiff and the carrier (from whom the Plaintiff bought the G2x) that everyone must arbitrate the case. 

    End result, this class action is dismissed, the lawyers quit the now-$500-value case, and LG escapes responsibility for its bad actions (and so too does the carrier.)

    Some of you may be asking why wasn’t T-Mobile sued.  Most likely it’s the U.S. Supreme Court case AT&T Mobility v. Concepcion, a case that ended all consumer class action litigation.

    Note: T-Mobile recently sent you a revised arbitration clause that takes advantage of this new case.  (All businesses did this). ,

    In the lawsuit the lawyers did not even mention the carrier from whom the Plaintiff bought the G2x, lest LG drag in (T-Mobile?) as a “necessary and indispensable party.” 

    What LG will do is invoke the carrier’s arbitration clause on the class action, saying that since there’s an arbitration clause between the Plaintiff and the carrier (from whom the Plaintiff bought the G2x) that everyone must arbitrate the case. 

    End result, this class action is dismissed, the lawyers quit the now-$500-value case, and LG escapes responsibility for its bad actions (and so too does the carrier.)

    According to a very close friend of mines that works at LG, they had a software update that would fix all the issues that the G2X had, but T-Mobile declined to approved and instead told them to include it in their gingerbread update that wouldn’t be out until Aug. T-Mobile did not want to do an over the air update for some unknown reason and decided it would be best to make customers wait for a update that was months away! If anything, T-Mobile is who this should be against and i feel like the truth will come out if this makes it to court

      An OTA update would make T-mobile responsible for any issue’s it might cause the phone.  That’s why Vibrant updates were done through Samsung Kies and not OTA.  Does anyone remember the MyTouch 3G 2.2 debacle?  Lot’s of phones had to be replaced because of that.  Why would T-mobile want to go through that again when it’s an LG issue?  LG should be stepping up on their own just as Samsung did and offer the update through their own downloader tool.

      T-Mobile has an obligation to uphold and that is Quality Control, wich supersedes all claims that it is soley LG’s fualt because the consumer bought it from T-Mobile, not LG.

    Mine worked fine out of the box, guess I am lucky… I never keep any phone stock however and this phone is a custom beast, basically rooted out the box (unlocked bootloader) which attracted a lot of top notch hackers (including cyonagen himself). Thousands of people are on XDA in the G2x forums talking about how much they like the their phone so 90% thinking is garbage is overkill…Since you had it from day one it was probably the first wave that were more defective…

          Glad to see you have the cash to waste on random electronic devices. but unforunately not everyone is in the same boat. You act like phones these days are not an integral part of peoples lives. Just like the above post stated, most people use them for everyday needs most important…making calls….if the phone cant even stay on to make a simple phone call what use is it?  If you have no complaints cause your phone works fine, thats great and all but dont sit here and try and belittle people who have valid complaints. These people have valid reasons to be upset, LG made a mediocre product and essentially are not fixing the issues. No matter what scenario, this kind of service is unacceptable.

    I updated the phone to the new gingerbread update and the phone had a few more issues that were not present before…in addition to the random freezing the phone does, the phone now will silence the key tones when typing on the keyboard while you are typing, also the phone goes though a full charge quite fast and finally the WIFI is almost non existant in the phone. I have a G2 in the house as well and the phone outperforms this one in reliability all day long.

    but here is the kicker…i called T-Mobile after the update to gingerbread to report all these problems that i was hping GB would fix (i really hoped!!!) but they acknowledged that there were issues with GB and that they were taking the phones back and exchanging them with phones with the old software and hoping that another update would fix the issues again…

    this is crazy!!!  they are shipping me a new phone with the same old problems and they know it!!!

    BS!!!

    i can only hope a fix comes soon…i do not mind the phone, i just wished it worked like all the other phones i buy and spend good money on…

    Sounds like TMobile is continuing this issues with the HTC Sensation.  My touch screen is malfunctioning regularly, less than a month after I bought it.  If you do an internet seach regarding this issue, you’ll find that XDA-developers have over 50 pages (65 at last count) regarding this.  My wife works at T-Mobile and put me in touch with “special accounts” (I believe) and they told me that this is a known problem with no known fix and that there was nothing that they could do.  I asked, “So you’re telling me that you took my money, knowing that this phone had major issues and that now you are refusing to do anythig to remedy my issue?”  The answer that I received was “yes”.  A number of different things come to mind including “receiving money under false pretenses” and “breach of contract”.  HTC and T-Mobile collectively suck (in my humble opinion). 
    If you try to pull this (in many states) with a car, you have a “lemon law” to help.  What do we have with the cell phone industry?

    I have this phone and it sucks !!!! I HOPE THEY DO SOMETHING ABOUT IT . YES ITS JUST A PHONE BUT WHEN YOU PAY FOR SOMETHING AND YOU EXPECT FOR IT TO WORK AND IT DOES NOT YOU BE PISSED OFF TOO !!!!!
